Patricia Wilcox Wins $354,000 Default Judgment for St. Louis Mobile Marketing Agency
Weiss & Associates, P.C. attorney Patricia Wilcox represented St. Louis mobile marketing agency The Spark Agency (n/k/a Switch Liberate Your Brand) in a lawsuit against 02Connect over a wireless network 02Connect installed. In early October 2009, a St. Louis judge socked O2Connect with a $354,000 default judgment after no one representing O2Connect showed up for an Oct. 5 trial in St. Louis Circuit Court. O2Connect had sued Spark in 2007 after the agency cancelled services less than three months into a two-year contract for a wireless network and Internet and phone services. Spark, however, filed a counterclaim saying that O2Connect didn’t get the wireless system fully functioning by a January 2007 deadline. At the end of February 2007, Spark and its clients started complaining about the slowness of the network and e-mail connections. In an affidavit, a Spark executive said the problems cost the agency a little less than $354,000 in overtime, equipment, mileage charges, consultant and O2Connect’s fees. The case is O2Connect v. The Spark Agency Inc., 0722-CC01192.
