We regularly get calls and e-mails regarding all sorts of property rights questions and issues: My neighbor's garden has been on my property for many years, and now they won't let me tear up the part on my property. Or, the neighbor's tree is tilting precariously close to my roof and over the driveway. Perhaps it is a shared driveway, and your neighbor is refusing to pay for the cost to repave or fix it. And the ever-present question about encroachment by fences not being on the "right side" side of the property line!
Unfortunately, the advice we give starts with, "It depends." Property law questions are fact-specific inquiries, and documentation to back up those facts is critical to advising regarding both rights and options.

Patricia Wilcox Wins $354,000 Default Judgment for St. Louis Mobile Marketing Agency
Weiss & Associates, P.C. attorney Patricia Wilcox represented St. Louis mobile marketing agency The Spark Agency (n/k/a Switch Liberate Your Brand) in a lawsuit against 02Connect over a wireless network 02Connect installed. In early October 2009, a St. Louis judge socked 02Connect with a $354,000 default judgment after no one representing 02Connect showed up for an Oct. 5 trial in St. Louis Circuit Court. 02Connect had sued Spark in 2007 after the agency cancelled services less than three months into a two-year contract for a wireless network and Internet and phone services. Spark, however, filed a counterclaim saying that 02Connect didn’t get the wireless system fully functioning by a January 2007 deadline. At the end of February 2007, Spark and its clients started complaining about the slowness of the network and e-mail connections. In an affidavit, a Spark executive said the problems cost the agency a little less than $354,000 in overtime, equipment, mileage charges, consultant and 02Connect’s fees. The case is 02Connect v. The Spark Agency Inc., 0722-CC01192.
